Rhode Island Immigration Laws

Since July 2023, Rhode Island residents can obtain a driver privilege card regardless of immigration status if they can pass the written and road tests and maintain auto insurance. The card cannot be used as evidence of citizenship or immigration status and cannot serve as a basis for criminal investigation or arrest.

Rhode Island allows undocumented students who attended a Rhode Island high school for 3+ years and graduated to pay in-state tuition at CCRI, Rhode Island College, and the University of Rhode Island, regardless of immigration status.

Rhode Island does not require private employers to use E-Verify. A previous executive order mandating E-Verify for state contractors and vendors was in effect from 2008 to 2011 but has since lapsed. Participation is voluntary unless required by a federal contract.

Rhode Island wage and hour protections apply to all workers regardless of immigration status. Employers cannot use immigration status as a defense against wage claims.
