North Carolina Employment Laws
North Carolina is an at-will employment state. The state's primary employment protections come from the NC Wage and Hour Act, the Equal Employment Practices Act (EEPA), and the Retaliatory Employment Discrimination Act (REDA). NC does not have a comprehensive state anti-discrimination statute equivalent to Title VII — the EEPA articulates a policy against discrimination but recent case law is only now recognizing a private right of action. NC minimum wage is $7.25/hour (same as federal).

Statute of Limitations
Unpaid wage claims under the NC Wage and Hour Act must be filed within 2 years. REDA retaliation complaints must be filed within 180 days. Federal EEOC charges must be filed within 180 days.
Key North Carolina Statutes
Either party may terminate the employment relationship at any time, with or without cause. Exceptions: wrongful discharge in violation of public policy, breach of employment contract, and REDA-protected retaliation.
NC minimum wage is $7.25/hour (follows federal). Overtime is time-and-a-half for hours over 40. Employers must pay all promised wages on regular paydays. Successful claimants can recover unpaid wages plus interest, costs, and attorneys' fees.
Declares it the public policy of NC to protect employees from discrimination based on race, religion, color, national origin, age, sex, or handicap. Applies to employers with 15+ employees. Recent court decisions (2024–2025) have recognized a private right of action.
