Wisconsin Immigration Laws

Wisconsin takes a mixed approach to immigration. There is no state-level E-Verify mandate for private employers (though legislation is pending). Undocumented immigrants cannot obtain driver's licenses. Several cities (Milwaukee, Madison) have adopted immigrant-friendly policies, though DHS designated them as sanctuary jurisdictions in 2025. In-state tuition for undocumented students was allowed briefly (2009) but repealed in 2011.

Undocumented immigrants cannot obtain a Wisconsin driver's license. DACA recipients can obtain a license. Legislative proposals to expand eligibility have been introduced but not passed.
