Arkansas Immigration Laws

Arkansas takes a strong enforcement posture on immigration. The state bans sanctuary cities and requires local law enforcement to cooperate with federal immigration authorities. E-Verify is mandatory for public contractors (and expanding). Undocumented residents cannot obtain driver's licenses. There is no in-state tuition for undocumented students (DACA recipients may qualify). Arkansas provides no state-funded benefits to undocumented individuals.

Anti-Sanctuary City LawArk. Code Ann. § 14-1-109 (as amended by Defense Against Criminal Illegals Act, 2025)

Prohibits all political subdivisions from adopting sanctuary policies that limit cooperation with federal immigration authorities. Local law enforcement cannot be prohibited from inquiring about immigration status during lawful stops or from cooperating with ICE. Non-compliant cities are ineligible for discretionary state funds.

E-Verify (Public Contractors)Ark. Code Ann. § 19-11-105; Act 157 of 2007

State agencies and political subdivisions cannot enter into public contracts for services with businesses that knowingly employ unauthorized workers. Contractors must certify they do not employ illegal immigrants. E-Verify is expanding in the public sector; private employers are not universally mandated but are subject to I-9 requirements.

Driver's Licenses (Legal Presence Required)Ark. Code Ann. § 27-16-801 et seq.

Arkansas requires proof of lawful presence in the United States to obtain a driver's license or state ID. Undocumented immigrants are not eligible for any type of driving credential.

In-State Tuition (DACA Only)Arkansas Higher Education Policy

Arkansas does not provide undocumented residents with in-state tuition or state financial aid. Eligible DACA recipients may access in-state tuition rates and professional/occupational licensure.

Arkansas prohibits any state or local government from providing public benefits or services to undocumented immigrants, consistent with federal PRWORA requirements.
